
Update: With a 40-28 vote, House lawmakers defeated House Bill 1201.
Background: House Bill 1201 would requite school nurses, counselors, teachers, and administrators to notify a student’s parent or guardian if they discuss a student’s questions regarding “gender confusion or gender dysphoria.”
Our position: The ACLU of South Dakota opposes House Bill 1201. Forced outing bills like this claim to protect parental rights, but they do no such thing. Instead, these bills endanger trans students, who have the right not to be outed and to be treated with dignity and respect at school.
